Fine imposed on pharmaceutical companies by the Competition Board

The Competition Board has decided to impose an administrative fine of 42.1 million Turkish liras on Menarini Health and Pharmaceutical Industry Trade Inc., and 35.7 million Turkish liras on Genveon Pharmaceutical Industry and Trade Inc.

According to the statement published on the Competition Authority’s website, the investigation concerning the mentioned companies has been concluded. The statement mentioned that Menarini Health and Pharmaceutical Industry Trade Inc., which includes products like Arveles, Sulcid, Sustenium, Kaleidon, and Genveon Pharmaceutical Industry and Trade Inc., which includes products like Clasem, Sidefer, Cistus Pastil, sent settlement texts within the scope of the investigation to determine whether they violated the Law on the Protection of Competition. The statement included the outcomes of these settlement texts, stating: “Menarini Health and Pharmaceutical Industry Trade Inc. exchanged sensitive competitive information with its competitor and violated the law in this way. Therefore, an administrative fine of 42,148,808 Turkish liras was imposed on Menarini Health and Pharmaceutical Industry Trade Inc. Genveon Pharmaceutical Industry and Trade Inc. engaged in collusive actions by making gentleman’s agreements not to employ each other’s employees in the labor market and violated the law in this way. Therefore, an administrative fine of 35,722,195 Turkish liras was imposed on Genveon Pharmaceutical Industry and Trade Inc., and it was decided to conclude the investigation with a settlement for these companies.”

The statement also reminded that within the same investigation, GlaxoSmithKline Pharmaceuticals Industry and Trade Inc. was fined 33,321,564 Turkish liras, Abdi Ibrahim Pharmaceuticals Industry and Trade Inc. 184,363,976 Turkish liras, Bilim Pharmaceuticals Industry and Trade Inc. 155,488,332 Turkish liras, and Drogsan Pharmaceuticals Industry and Trade Inc. 30,593,234 Turkish liras in administrative fines, and the investigation was concluded with a settlement for these companies.
